1. Acceptance of Terms

By accessing or using GOpher Forms ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

GOpher Forms is a safety compliance management platform that provides:

• Digital safety form creation, assignment, and submission.
• GPS-verified work session tracking.
• Worker credential and certification management.
• Real-time notifications and alerts.
• Company and worker management tools.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use.

Company owners are responsible for managing access and permissions for their workers and sub-owners.

4. Subscription & Billing

GOpher Forms offers a free tier and paid subscription plans. For paid plans:

• Pricing is per user, billed monthly or yearly as selected.
• Workers always join free — only company owners pay.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis within 30 days of purchase.
• We reserve the right to change pricing with 30 days advance notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Submit false, misleading, or fraudulent safety forms or data.
• Attempt to gain unauthorized access to other accounts or systems.
• Upload malicious content, viruses, or harmful code.
• Use the Service to harass, abuse, or harm others.
• Reverse engineer, decompile, or disassemble the Service.
• Resell or redistribute the Service without authorization.

6. Data Ownership

You retain ownership of all data you submit through GOpher Forms, including forms, photos, signatures, and credentials. By using the Service, you grant us a limited license to store, process, and display your data as necessary to provide the Service.

Company owners are responsible for ensuring they have appropriate consent from workers to collect and process their data through the platform.

7. Safety Compliance Disclaimer

GOpher Forms is a tool to assist with safety compliance management. It does not replace professional safety advice, legal counsel, or regulatory compliance obligations. You are solely responsible for:

• Ensuring your safety forms meet applicable regulatory requirements.
• Verifying the accuracy of submitted form data.
• Maintaining compliance with all applicable workplace safety laws.
• Verifying worker credentials and certifications independently.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice when possible.
• Temporarily suspend access for emergency maintenance or security issues.
• Modify or discontinue features with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, GOpher Forms and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the Service will be revoked.
• We will retain your data for a reasonable period to allow export.
• After the retention period, your data will be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email at least 30 days before they take effect. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Alberta.
